TOWN OF ADDIS MINUTES

The regular meeting of the Mayor and Town Council for the Town of Addis was called to order by Mayor Bourgeois at 7:00 p.m. on Wednesday, May 5, 2004 at the Addis Municipal Center. The Pledge to the Flag was led by Mayor Bourgeois.

Roll Call: Present: Mayor Bourgeois; Councilmen Cazes; Gauthreaux; H. Landry; J. Landry; Parrish.
Absent: None

Minutes: The minutes of the regular meeting of April 7, 2004 were approved, as mailed, on a motion by Councilman J. Landry, 2nd by Councilman H. Landry and adopted.

Resolutions: Mayor Bourgeois deviated from the Agenda in order to present resolutions to those National Guardsmen from this area are being called to active. The resolution was offered by Councilman Cazes, 2nd by Councilman H. Landry and adopted. A copy of the resolution is attached to and made a part of these minutes. Resolutions were presented to Lenny Loupe; Jeremy Walker and Raleigh Warner, Jr. Already deployed were Casey Batts and Michael Averette.

Delahaye Subdivision: Following a lengthy discussion, a motion was made by Councilman H. Landry, 2nd by Councilman J. Landry to accept the recommendation of the Engineer and Town Attorney to accept the final plat of Acadian Crossing Subdivision with the contingency that (1) the additional one year warranty on the sewer main and the mandrel test be run at end of the warranty period (2) an additional one-year warranty be placed on the road everywhere the service crosses the road except the 4 pipes which have already been repaired and (3) the drainage servitude as depicted on the final plat is in dispute; Mr. Delahaye has agreed that in the event that the present servitude is comprised, the subdivider will afford the Town sufficient room to maintain the drainage servitude. The motion was adopted.
Dana Larpenteur, attorney, will draw up the legal papers necessary.
Mr. Cletus Langlois presented the final plat for signatures.

Parish Council: Mr. Mouch reported that (1) the light poles are being delivered for the various parks, (2) a discussion was held on the policy to be used when the parks are booked for private parties (3) Parish prisoners are putting a fence and shoveling gravel at Myhand Park (4) a lengthy discussion was held on the garbage contract which is up for renewal (5) the Whirlpool building is vacant. An architect has been contacted to get a cost analysis on renovations.

Police Report: The monthly police report, given by Chief Anderson, included
193 citations issued; 4 vehicle accidents worked ; 9 misdemeanor arrests; 3 felony arrests.
The misdemeanor arrests were 3-disturbing the peace; 3 simple battery; 1 remaining after forbidden; 1 hit and run and 1 warrant. Felony arrests were: 2 cruelty to a juvenile and 1 unauthorized use of a motor vehicle. The new police car was received toda

Sewer Report: The monthly sewer report, given by John Artigue, included 8 equipment failures; 2 leaks; 1 grease problems; and 2 miscellaneous calls. The filter was replaced at the First Street Pump station.

Planning & Zoning: Mayor Bourgeois advised that Butch LaBauve, Pastor of the River Church, will attend the Planning & Zoning meeting. He wants to build a multi-purpose building on property adjoining the church, which is Zoned R-100. He has indicated his desire to house some individuals on this property to finish their half-way house service and possibly do some work for the River Church.

Old Business: Impact Fee: A discussion was held on the $350.00 per unit impact fee set by the Town. One developer would like to deviate from the schedule of payment set in the Ordinance, which is ½ at acceptance of final plat and the other half being due when the lots are sold. One developer would like to pay $200.00 per unit when the final plat is approved and the other $150.00 paid by the purchaser at the time the lot is sold. It was the general concensus of the Council to leave payment of the Impact Fee as set out in the existing Ordinance.

Myhand Street Culvert: A discussion was held on the catch basins which will be installed in Myhand ditch at the railroad. The Parish was contacted for assistance. A motion was made by Councilman Gauthreaux, 2nd by Councilman Parrish to go ahead and pay for one catch basin and culvert for the Myhand Street ditch. The motion was adopted.

Garbage Contract: Mr. PeeWee Berthelot presented a plan for garbage pickup which was received from BFI which would utilize a small “dumpster” at each house. Mayor Bourgeois reviewed the pros and cons of this system and a general discussion was held. Mayor Bourgeois thanked the Parish for going out for bids for the garbage collection contract.

Ordinance #2004-1: Mayor Bourgeois opened a Public Hearing to discuss proposed Ordinance #2004-1 which amends the Addis Code of Ordinances to require 100’ sidelines on lots in Zones R-100A; R-100B and R-80 and other related matters.
Following the reading of the Ordinance and discussion, a motion was made by Councilman H. Landry, 2nd by Councilman Cazes to approve the Ordinance , as amended to show that corner lots shall have extra widths sufficient to permit establishment of a building line in compliance with the Zoning Ordinance. Peter Messina Road Improvements: Mayor Bourgeois advised that Entergy has moved their electric lines. Cox Communications will be contacted to move theirs.

Messina Property: No further information is available on this project.

Adult Stores: A discussion was held on prohibiting the sale of X-rated videos, etc. A motion was made by Councilman H. Landry, 2nd by Councilman Cazes to authorize Mayor Bourgeois to pursue an Ordinance to address this matter within the Town of Addis.

Tree Trimming: John received two quotes on tree trimming on Foret Street, and Bird Heights. They were: Baton Rouge Tree Service $1,075.00
American Tree & Stump $ 850.00
A motion was made by Councilman H. Landry, 2nd by Councilman Gauthreaux to accept the low bid of $850.00 by American Tree & Stump. The motion was adopted.

Grass Cutting: A motion was made by Councilman Gauthreaux, 2nd by Councilman Cazes to advertise for bids for grass cutting along the Highway. The motion was adopted.

Open Containers: A motion to approve the request of DynMcDermott/Cathy Prejean for an open container permit for a company picnic at Myhand Park on May 22nd was made by Councilman H. Landry, 2nd by Councilman Cazes and adopted.
A motion to approve the request of Shintech/Sharon Dupont for an open container permit for a company picnic at Myhand Park on May 8th, was made by Councilman Gauthreaux, 2nd by Councilman Cazes and adopted.
A motion to approve the request of Nell Pepitone for an open container permit for a Going Away party, at the Civic Center, on May 8th was made by Councilman Cazes, 2nd by Councilman H. Landry and adopted.

At 8:40 p.m., a motion to temporarily adjourn the meeting to hold the regular meeting of the Board of Commissioners for Fire Sub-District #1 of WBR was made by Councilman H. Landry, 2nd by Councilman Gauthreaux and adopted.
At 8:45 p.m. a motion to reconvene the regular meeting of the Mayor and Town Council was made by Councilman Cazes, 2nd by Councilman Parrish and adopted.
