SPECIAL MEETING OF THE Town of Addis, Wednesday, November 14, 1979
A special meeting of the Mayor and Board of Aldermen was held at 7:00 P.M. on Wednesday, November 14, 1979 at the Town Hall.
Present: Mayor Pro Tempore Rabalais; Aldermen ~I DeBlanc, Guidry; Richard.
Absent: Mayor W. E. Fitzgerald; Alderman Carroll.
This meeting was called to discuss action to be taken in regards to an alleged ordinance violation by Fisher's Trailer Park owner.
In reply to a question concerning councilmen testifying in a case of this nature, Mr. Larpentur, attorney, advised that they could act as private citizens and that each and every citizen has a vested interest in seeing that laws of the town are kept. He further advised that he felt Mrs. Fisher is definitely in violation of ordinance 76‑2 Section 5A, and that Mrs. Fisher would not have to testify since this is a criminal offense and she is protected by the Fifth amendment. He told the Board that the case would come before the Mayor's court first and, if found guilty, she could appeal to a higher court.
Mr. Guidry advised that he felt that it would be difficult to get witnesses due to the lapse in time from the original date of violation. Mr. Larpentur said that his file on the case dates back to 1977. The general feeling was that action on the violation should have been taken at that time.
Mr. Larpentur advised that his recommendation was not to prosecute the case due to the lapse in time from the original violation and that even though he feels there is a legal violation, he does not believe there is enough concrete evidence to prosecute the case to a successful conclusion. He further recommended that Mrs. Fisher be advised that she is still in violation and she should be asked to move the trailer in question.
A motion was made by Mr. Guidry, seconded by Mr. DeBlanc and approved to accept the recommendations of the Town Attorney and drop the matter against Mrs. Fisher. It was stressed in further discussion that in the future, violations would be taken care of immediately and not be allowed to drag on over a period of time.
It was decided that the clerks would obtain the serial number on all trailers being moved into Town in the future for identification purposes.
At 7:21 P.M., the meeting was adjourned on a motion by Mr. Guidry seconded by Mr. DeBlanc and approved.
