TOWN OF ADDIS MINUTES

The regular meeting of the Mayor and Town Council for the Town of Addis was held at 7:00 p.m. on Wednesday, September 2, 2009 at the Addis Municipal Center. The Pledge to the Flag was led by Mayor Bourgeois.

Roll Call: Present: Mayor Bourgeois; Councilmen Cazes; Gauthreaux; Landry; Parrish; Toups.
Absent: None

Minutes: The minutes of the August 5th meeting were approved, as mailed, on a motion by Councilman Gauthreaux, 2nd by Councilman Cazes and adopted.

Additions to Agenda: The following items were added to the agenda on a motion by Councilman Toups, 2nd by Councilman Parrish and adopted – (1) National League of Cities (2) Open Container request (3) River Landing (4) Condemnations.

Correspondence: Mayor Bourgeois read a letter from Cox Communications regarding a change in cable service. The Mayor announced a Town Hall meeting to be held at the Community Center in Port Allen by Congressman Cassidy at 5:30 p.m. on Thursday. Mayor Bourgeois also announced that the Town of Addis was awarded the Community Achievement Award at the LMA convention for the lighting on the highway.

Special Business: Parish Council: Council President Berthelot advised that the Council is almost finished with the drafting of the new animal control ordinance and a copy will be given to the Town for their review upon completion.

Police Report: The police report for the month of August, given by Chief Anderson, included 148 citations issued; 14 misdemeanor arrests; 1 felony arrest; and 4 vehicle wrecks worked. The misdemeanor arrests were traffic 3; disturbing the peace 5; warrants 3; open container 1; resisting an officer 1; trespassing 1. The felony arrest was narcotics with firearm.

Sewer Report: The sewer report, read by the Mayor, included 30 equipment failures; 5 jammed pumps; 4 leaks; and 1 tank relocation. One sewer tie-in inspection was made in Sunset Place; and two grinder pumps were replaced.

Planning & Zoning: A motion was made by Councilman Parrish, 2nd by Councilman Toups to ask Mr. Charles Landry to conduct a training session for the Planning & Zoning Commissioners. The motion was adopted.

Old Business: Revise Budgets Ordinance #2009-8: A public hearing was held on the Ordinance for the proposed revised budgets for the General Fund and Sewer Enterprise Funds. Mayor Bourgeois reviewed the changes in the budgets and asked for questions and/or comments. Following the public hearing, a motion was made by Councilman Parrish, 2nd by Councilman Cazes to approve the Ordinance for the revised budgets of the General Fund and Sewer Enterprise Fund, as presented. The motion was adopted on the following roll call vote: Yeas: Cazes; Gauthreaux; Landry; Parrish; Toups. Nays: None. Absent: None Abstaining: None

Ordinance #2009-9: Mayor Bourgeois opened a public hearing on Ordinance #2009-9, an ordinance to change the starting time of Town Council regular meetings from 7:00 p.m. to 6:00 p.m. The ordinance was read in full by Mr. Larpenteur. Following the public hearing. A motion was made by Councilman Toups, 2nd by Councilman Gauthreaux to adopt Ordinance #2009-9, to change the time of the Town Council regular meetings from 7:00 p.m. to 6:00 p.m. The motion was adopted on the following roll call vote: Yeas; Cazes; Gauthreaux; Landry; Parrish; Toups. Nays: None Absent: None Abstaining: None

Sewer Building: Mayor Bourgeois asked three times for additional bids from the floor on the proposed sewer storage building. There were no further bids and those received were opened with the following results: (1) Williams Construction - $85,648.00; (2) Level Home Builders - $68,918.00 (3) Kelly & Wilson Contractors, LLC $67,983.00 with an additional $2,040.00 if required to furnish performance bond and (4) Tullier Services LLC $75,000.00 with 5% of bid for bonds.
A motion was made by Councilman Gauthreaux, 2nd by Councilman Landry to table action on the bids tonight and let Architect Brian Budd review the bids and the bid will be awarded to the contractor he recommends. The motion was adopted.

LCDBG Update: Mayor Bourgeois advised that he spoke with Mr. Ed Hannum, Consultant, about submitting an application for a grant to repair Peter Messina Road. A door to door survey will have to be done on Peter Messina Road to ascertain if it is eligible for the grant.

National League of Cities: Mr. Larpenteur advised that he will be unable to attend the Conference in San Antonio due to his son's senior year of wrestling. Mayor Bourgeois asked if any other councilman is interested in going to let the office know as soon as possible.

New Business: Mustang Engineering: Representatives of Sunland Contruction/Mustang Engineering asked for a route on West Main Street for their pipes and equipment to be brought to a pipeline location west of Addis. A lengthy discussion was held on the condition of the road and possible damage to the road with this type of heavy equipment.
Following the discussion, a motion was made by Councilman Parrish, 2nd by Councilman Cazes to allow the access of Main Street for the movement of pipes and equipment by Sunland Construction/Mustang Engineering, contingent upon a $100,000 bond being furnished to cover any damages, and also contingent upon an agreement being worked out between their company attorney and the Town attorney. The motion was adopted.

LGAP Resolution: A resolution was offered by Councilman Toups, 2nd by Councilman Landry to authorize the Mayor to apply for a $35,000. grant to complete Phase 3 of the Myhand Street culvert project. The motion was adopted.

Secretary of Chief's Conference: A motion was made by Councilman Cazes, 2nd by Councilman Gauthreaux to authorize Nell Pepitone to spend $500.00 for a meal for participants at a conference for the Secretary to Police Chiefs conference she is sponsoring in October. The motion was adopted.

Water Board Appointment: Mr. Shane Lopez was reappointed to a new 5-year term on WBR Water Works #1 board, effective 9/9/09, on a motion by Councilman Landry, 2nd by Councilman Toups. The motion was adopted.

Ordinance Review: A motion was made by Councilman Gauthreaux, 2nd by Councilman Cazes to authorize Town Attorney Larpenteur to review ordinances in the Code of Ordinances book to correct conflicts. The motion was adopted.

DEQ Funding: Mayor Bourgeois advised that the Town has been awarded a $1,500,000. loan from DEQ to do upgrades to the sewer plant and system.

Open Container: An open container permit requested by Brandy LeBlanc for a fund raiser for Infant Tristin Turner to be held at Myhand Park on October 3rd was approved, on a motion by Councilman Parrish, 2nd by Councilman Landry and adopted.

River Landing: A resident in River Landing Subdivision requested a 3-stop on the corner of her street in River Landing. Mayor Bourgeois advised that he asked her to discuss this situation with the Homeowners Association and also have the police review the area to see what signs would be appropriate.

Condemantion: A motion was made by Councilman Gauthreaux, 2nd by Councilman Toups to contact Dean Hotard to do a review for condemnation on two trailers located on Main Street. The motion was adopted.

Public Comments: In answer to an inquiry about the streets in West River Subdivision cracking, Mayor Bourgeois advised that Mr. Oscar Boudreaux, Engineer is checking into this . Mrs. Kleinpeter of the Planning & Zoning Commission thanked the Mayor and Council for the new format of the Code of Ordinances book.

Fire Meeting: At 7:45 p.m. a motion was made by Councilman Toups, 2nd by Councilman Cazes to temporarily adjourn the meeting to hold the meeting for Fire Sub-District #1. The motion was adopted.
At 8:00 p.m. the meeting was reconvened on a motion by Councilman Cazes, 2nd by Councilman Gauthreaux and adopted.

Committee Reports: Finance: A motion to pay bills presented, and found in order, was made by Councilman Landry, 2nd by Councilman Gauthreaux and adopted.

Police: Ass't Chief Jones advised that the Town has not received moneys on the Stimulus grant yet due to some confusion on the submission of the request form. This is being taken care of.

Personnel: Executive Session later.

Drainage: Projects for the future will be discussed at a later date.

Streets, Roads, etc. - No further report.

Executive Session: At 8:07 p.m. a motion to go into Executive Session to discuss personnel was made by Councilman Toups , 2nd by Councilman Cazes and adopted.

A motion to return to regular session was made at 8:40 p.m. by Councilman Cazes, 2nd by Councilman Parrish and adopted.

Mayor Bourgeois advised that a personnel matter was discussed in Executive Session.

Mayor Bourgeois reminded those present that the annual meeting and employee appreciation banquet will be held at 6:30 p.m. on Thursday, September 10th.

The meeting was adjourned at 8:42 p.m. on a motion by Councilman Parrish, 2nd by Councilman Gauthreaux and adopted.
