TOWN OF ADDIS MINUTES

The regular meeting of the Mayor and Town Council was held at 7:00 p.m. on Wednesday, April 1, 2009 at the Addis Municipal Center. The Pledge to the Flag was recited, and Mayor Bourgeois asked for a moment of silence in memory of John Artigue's mother who was buried today.

Roll Call: Present: Mayor Bourgeois, Councilmen Cazes; Gauthreaux; Landry; Parrish; Toups.
Absent: None

Minutes: The minutes of the regular meeting of March 4th were approved, as mailed, on a motion by Councilman Toups, 2nd by Councilman Cazes and adopted.

Additions to the Agenda: The following items were added to the agenda on a motion by Councilman Gauthreaux, 2nd by Councilman Toups and adopted.
(1) Garbage Contract (2) Tree Cutting (3) River Church and (4) Rabies Ordinance

DEQ BOND RESOLUTION: Mayor Bourgeois asked to deviate from the agenda and introduced Mr. David Henderson of Foley & Judell, L.L.P. Mr. Henderson is representing the Town of Addis as Bond Attorney on the DEQ Bond project. Mr. Henderson explained the program the Town is participating in and presented a resolution to be adopted by the Council. Following his presentation, a resolution “declaring the intention of the Town Council of the Town of Addis, Louisiana, to issue in the name of the Town, Sewer Revenue Bonds in an amount not to exceed One Million Seven Hundred, Fifty Thousand Dollars ($1,750,000) for the purpose of acquiring and constructing additions, extensions, and improvements to the sewer utility system of the Town, and paying the costs of issuance thereof; generally describing said Sewer Revenue Bonds and the security therefor; authorizing the newspaper publication of a notice of such intention setting forth a date and time when said governing authority will meet in open and public session to hear any objections to the proposed issuance of such Bonds; providing for the filing of a petition by a certain percentage of the electors of the Town objecting to the issuance of the proposed Bonds unless an election is held on the question of the issuance thereof; applying to the State Bond Commission for the approval of the contents of the proposed notice of intention and for the issuance of the bonds; and providing for other matters in connection therewith”, was offered by Councilman Cazes, 2nd by Councilman Landry and adopted on the following roll call vote: Yeas: Cazes; Gauthreaux; Landry; Parrish; Toups Nays: None Absent: None Abstaining: None

Mr. Oscar Boudreaux, engineer, was recognized and advised that the contract on the Shaw Sewer Line has been signed with the contractor meeting all insurance and other requirements. A motion was made by Councilman Gauthreaux, 2nd by Councilman Cazes to authorize Mayor Bourgeois to sign the Notice to Proceed on the “Shaw” project. The motion was adopted.

Following a lengthy discussion on the right-of-way agreement needed from Mr. Peter Marshall for the installation of a sewer line, a motion was made by Councilman Gauthreaux, 2nd by Councilman Parrish to authorize Town Attorney Larpenteur to attempt to contact Mr. Marshall and negotiate with him for a right-of-way across his property. Parish Council: Mr. Randy Mouch was recognized and advised that the sale of the VFW building and property to the Parish has been completed. He further advised that the Kite Festival is this weekend: Friday 9:00 am to 2:00 pm; Saturday and Sunday 11:00 am to 6:00 p.m.
The books for the rental of the community centers from July 1st to December 31st,m, will be opened on April 5.

Police Report: The March police report, given by Chief Anderson included 99 traffic citations issued; 14 misdemeanor arrests; 1 felony arrest and 4 vehicle wrecks worked.
The misdemeanor arrests were: 5-traffic; 2-disturbing the peace; 2-warrants; 1-resisting officer; 1-theft; and 3-failure to obtain trailer moving permit. The felony arrest was for unauthorized entry to an inhabited building.
Chief Anderson advised that the suit against the Town by Theresa Martin ended with a finding of the Town having no liability in the incident.

Sewer Report: The sewer report, read by Councilman Gauthreaux in the absence of John Artigue, included 17 equipment failures; 4 jammed pumps; 1 leak; 1 tank location and 3 miscellaneous calls. One tank lid was replaced, and the pump station in Plantation Ridge was started up.

Planning & Zoning Commission: A motion was made by Councilman Parrish, 2nd by Councilman Gauthreaux to accept the recommendation of the Planning & Zoning Commission and grant a Home Occupation license to Mr. L. J. Ourso, III for a Gunsmith Service. The motion was adopted.

Old Business: Generator: A motion was made by Councilman Gauthreaux, 2nd by Councilman Toups to accept the quote received from Blue Stream Services for a 80kw “Natural Gas” generator at a cost of $27,439.50. The motion was adopted.

Museum Update: Mayor Bourgeois advised that work has begun on the Phase I of the Museum park.

Office Equipment-police: Chief Anderson advised that he would like to purchase a FAX/Copier for his office, with a dedicated line for the FAX. Following a discussion, a motion was made by Councilman Cazes, 2nd by Councilman Landry to table the purchase of the FAX/Copier for a month to see what the sales taxes will be; and to give Chief Anderson the authority to investigate and have installed a line dedicated to the FAX machine., The motion was adopted.

Garbage Contract: A motion was made by Councilman Toups, 2nd by Councilman Parrish to continue the Local Service Agreement with the Parish concerning the garbage pickup for an additional five years, with an ending date of August 31, 2014. The motion was adopted.

Tree Behind Building: A motion was made by Councilman Gauthreaux, 2nd by Councilman Toups to accept the quote of $2,300.00 from We Care Tree Care, LLC to remove the large tree located next to the fence behind the municipal building. The motion was adopted.

River Church: A complaint about the occupancy of a church owned building in a residential area was discussed. Mr. Butch LaBauve will be asked to attend a meeting to discuss this complaint.

Rabies Ordinance: Mayor Bourgeois advised that the Parish recently revised their Code of Ordinances to include a new rabies vaccine. Following a discussion, a motion was made by Councilman Parrish, 2nd by Councilman Cazes to amend the Addis Code of Ordinances; Section 4, Article II to include the newest form of rabies vaccine for animals, with a public hearing to be held at the regular meeting of the Mayor and Town Council on May 6, 2009. The motion was adopted.

Census 2010 Resolution: A resolution affirming the Town of Addis' Support of and Partnership with the 2010 Census was offered by Councilman Toups, 2nd by Councilman Cazes and adopted on the following roll call vote: Yeas: Cazes; Gauthreaux; Landry; Parrish; Toups. Nays: none Absent: none Abstaining: None

Parking at Museum Park: Mayor Bourgeois asked the Council to be thinking about how parking will be handled at the park.

LGAP (formerly Rural Development): A motion was made by Councilman Cazes, 2nd by Councilman Gauthreaux, to name Phase 3 of the Myand Street culvert project as the target project for the 2009/2010 application for a Local Government Assistance Program (LGAP) grant, with a request of $25,000.00, and to pay a match of $2,500.00 over the proposed LGAP grant amount to complete Phase 3 of the project. The motion was adopted.

Health Insurance: A motion was made by Councilman Toups, 2nd by Councilman Landry to continue health insurance coverage for the Town's employees at the approximately 7% increase quoted by the health insurance provider. The motion was adopted.

Open Container: A request for an open container permit submitted by Millie Normand for the St John High School softball tournament on August 8th and 9th, was approved on a motion by Councilman Gauthreaux, 2nd by Councilman Cazes and adopted.

Public Comments: None

Fire Meeting: At 8:14 p.m. a motion was made by Councilman Toups, 2nd by Councilman Gauthreaux temporarily adjourn the meeting in order to hold the regular meeting of the Board of Commissioners for Fire Sub-District #1 of WBR. The motion was adopted.
At 8:29 p.m. A motion to return to regular session was made by Councilman Gauthreaux, 2nd by Councilman Toups and adopted.

Committees: Finance: A motion to pay bills which are found in order, was made by Councilman Parrish, 2nd by Councilman Gauthreaux and adopted.
A discussion was held on signing of bills by Councilmen.

Sewer: None Police: Chief Anderson asked for consideration of the payment for repairs to Officer DeCook's four-wheeler which was damaged on Mardi Gras parade day, and for which the insurance company denied liability.
A motion was made by Councilman Toups, 2nd by Councilman Parrish to pay for repairs on DeCook's four wheeler which was damaged on parade day, and authorize the Chief to authorize whatever vehicles are necessary on any particular event. . The motion was adopted on the following roll call vote: Yeas: Cazes; Landry; Parrish, Toups. Nays: Gauthreaux Absent: None Abstaining: None
Chief Anderson advised that he and Assistant Chief Jones attended a meeting on a DEQ COPS grant, and would like to hire at least two officers. The grant would pay for two years salaries and equipment needed.
A motion was made by Councilman Toups, 2nd by Councilman Gauthreaux to authorize the Mayor to approve and the Chief to apply for the stimulus grant as presented. The motion was adopted.

Personnel: None Drainage: None Building: Mayor Bourgeois advised that the sewer building is to be installed as soon as the dirt is compacted enough. Roads: Mr. Harry Landry asked that the roads in the subdivision be inspected as it has been a year since they were overlayed.

Adjourn: The meeting was adjourned at 9:06 p.m. on a motion by Councilman Parrish, 2nd by Councilman Cazes and adopted.
